Who we are

Richard & Sons Trucking operates the Living State RP community and the Services. Living State RP is a fictional roleplay setting. References to police, fire, medical, legal, government or other real-world institutions are part of the fiction and do not create any real-world authority, duty or emergency service.

We are not affiliated with Rockstar Games, Take-Two Interactive, Discord, FiveM or any other third-party platform. Those services have their own terms and policies, which continue to apply to you.

Eligibility

You must be at least 13 years old and old enough to use Discord under the laws where you live. The community may apply a higher age requirement for certain roles, channels or game content. If you are under 18, you must have permission from a parent or guardian to use the Services.

You must be able to enter into a binding agreement and must not be barred from using the Services under applicable law. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

Accounts and Discord

Accounts are linked to Discord. When you sign in, Discord provides us with your Discord user ID, username, display name, avatar and server membership, and may provide role information if the community bot is configured. We do not receive your Discord password.

Keep your Discord account and any device used to access the Services secure. You are responsible for activity that occurs through your account. Do not share, sell, transfer or impersonate an account. One person should use one account unless a staff member approves an exception.

We may require you to be a member of the Living State Discord server, to have a verified account, or to meet other community requirements. We may suspend or restrict an account if we believe it is compromised, abusive or being used to evade moderation.

Community rules

You must follow the rules posted in the Discord server and in-game, the reasonable instructions of staff, and applicable law. The following conduct is not allowed:

• Harassment, bullying, threats, hate speech, stalking or targeted abuse.
• Doxxing or publishing another person’s private information without permission.
• Sexual content involving minors, exploitation or any content that endangers a minor.
• Cheating, exploiting bugs, using unauthorized mods or attempting to gain an unfair advantage.
• Attempting to access accounts, servers, databases, staff tools or systems without authorization.
• Spam, scams, phishing, malware, fraud or deceptive impersonation.
• Using the Services to plan or commit real-world violence, crime or harm.
• Using roleplay as a pretext to harass, threaten or abuse another person.

Roleplay is fiction, but the people behind the characters are real. Consent, boundaries and the community rules continue to apply in character and out of character.

Game and CAD

The external CAD and dispatch board is a staff tool. Access is discretionary and may be limited, changed or revoked. CAD information can include call details, unit positions, staff notes, in-game character identifiers, vehicle plates and lookup results. Treat that information as confidential community data.

Do not use the CAD to stalk, monitor, dox or harass another person, to scrape or resell data, or to disclose staff-only information outside authorized community channels. Staff actions in the CAD may be logged and reviewed.

In-game property, currency, jobs, records and other virtual state have no real-world monetary value. We may correct, reset or remove virtual state when needed to fix errors, address abuse or maintain the game.

Your content

You retain ownership of the original content you create and submit, such as profile text, forum posts, screenshots, stories and other community contributions. By submitting content, you grant Richard & Sons Trucking a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, moderate and use that content to operate, promote and improve the Services.

You represent that you have the rights needed to submit the content and that it does not violate another person’s rights or applicable law. We may remove or restrict content that violates these Terms, community rules or a legal obligation.

Do not submit passwords, payment card numbers, government identification numbers, private addresses or other sensitive information that does not belong in a roleplay community.

Moderation and termination

We may warn, restrict, suspend or terminate your access to the Services, remove content, revoke CAD access or remove a linked role if we believe you violated these Terms, the community rules or applicable law, or if your conduct creates risk for the community. We may act immediately when we believe it is necessary to protect people or the Services.

You may stop using the Services at any time. Some provisions of these Terms continue after your access ends, including provisions about content licenses, disclaimers, liability and disputes.

If you believe a moderation decision was mistaken, contact the community team through the addresses below. A review is not guaranteed, and we may not be able to share information about another person’s account.

Third-party services

The Services depend on third-party platforms, including Discord, Cloudflare, FiveM and payment or donation providers. We do not control those platforms and are not responsible for their availability, content, security or privacy practices. Your use of a third-party service is governed by that service’s terms and privacy policy.

Links to external websites, donation pages, music platforms or community resources are provided for convenience. A link does not mean we endorse the destination or its content.

Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, error-free or available at any particular time.

We do not guarantee that data, characters, records, virtual property or account access will never be lost, corrupted or changed. You are responsible for keeping your own copies of content that matters to you.

Limitation of liability

To the maximum extent permitted by law, Richard & Sons Trucking and its owners, operators, volunteers and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill, access or opportunity, arising out of or relating to the Services or these Terms.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits rights that cannot be limited by law.

Changes

We may update these Terms to reflect changes to the Services, the community or the law. We will post the updated version on this page and change the effective date. If a change is material, we will make a reasonable effort to announce it on the website or in Discord. Continued use of the Services after the updated Terms take effect means you accept the updated Terms.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
